EU pushes nicotine pouch tax vote to November as Sweden stalls the whole directive
The Irish presidency moved the Tobacco Taxation Directive vote from October 9 to the November ECOFIN meeting, buying Sweden time to form a government — and more time to keep blocking the EU's first-ever pouch tax.
The EU's plan to impose its first-ever taxes on nicotine pouches just slipped on the calendar. The Irish presidency of the Council confirmed the vote on the Tobacco Taxation Directive will move from October 9 to the November meeting of EU finance ministers, after Sweden — the proposal's main holdout — asked for time to form a government following its September 13 election.
The presidency said it will "continue to engage bilaterally with the aim of securing unanimous political agreement at the November ECOFIN" meeting. Four EU diplomats told Politico the delay gives Sweden's next government room to consider the proposal — and, they hope, to soften its resistance.
What's at stake for pouches
The Commission's proposal, tabled in July 2025, would extend the EU's tobacco excise framework to nicotine pouches for the first time: a minimum of 25% of retail price, or €71.50 per kilogram. Sweden currently taxes pouches at €18.36 per kilogram — a gap that would roughly quadruple the Swedish levy if harmonized upward.
Sweden has been the directive's principal blocker, and the fight has become genuinely cross-party there. Finance minister Elisabeth Svantesson put it bluntly in June: "Other countries do not get to decide over our snus." Swedish advocates point to the country's smoking rate, which fell from just over 30% in 1980 to 5% in 2024, and argue that taxing pouches like cigarettes punishes the products that helped get it there.
Why the delay matters
Tax legislation in the Council requires unanimity, so one holdout stalls everything — and one senior EU official told Politico that if Sweden's incoming finance minister arrives without a mandate, "then it's over." The postponement to November cuts both ways: it hands Sweden time to settle a coalition, but it also gives the Irish presidency four more weeks of bilateral negotiation to find a text Sweden might accept, or an angle to isolate it.
For the pouch market, nothing changes immediately — but the November ECOFIN meeting is now the date to watch. If unanimity fails there, the likely outcome is the fragmented landscape we flagged when Sweden first rejected the proposal: pouches taxed heavily in some member states, lightly or not at all in others, with national governments free to go their own way.

Update, 29 September: the veto survives the government crisis
Two weeks later the picture is clearer — and it still points the same way. Sweden is now run by a caretaker government while coalition talks continue, and by democratic practice a caretaker ministry cannot sign up to compromises that bind the next government. Swedish officials at the country's Permanent Representation keep attending the Council's tax working groups with unchanged instructions: resist the proposal until a new government decides otherwise.
Swedish trade outlet Vejpkollen's analysis notes that there is broad parliamentary consensus in Stockholm on protecting smoke-free nicotine and on the principle that the EU should not dictate Swedish tax policy — so whoever ends up in government, the veto is expected to stay intact. One wrinkle: if coalition talks drag on past November, the caretaker ministers would have to seek a negotiating mandate from the Riksdag's new EU Committee, which reflects the post-election balance of seats. Even then, the analysis concludes, the risk of Sweden giving ground in Brussels is minimal. Earlier drafts of the directive had floated minimum taxes as high as €143 per kilo — more than six times Sweden's current rate — before the compromise level of €71.50 per kilo now on the table.
