The daily pulse of the nicotine pouch market

EU's nicotine pouch tax plan drops to €50 a kilo, and a November 9 vote is now locked in

Ireland's EU presidency has cut its proposed minimum excise rate on nicotine pouches again — from €80 to €50 per kilogram at full rate — and locked in a November 9 finance ministers' vote. Sweden, still without a confirmed government, remains the one country that can block the whole deal.

The EU's push to tax nicotine pouches across all 27 member states has a new number attached to it, and a hard date. Ireland's Council presidency has cut its proposed top excise rate again — from €80 to €50 per kilogram — and EU finance ministers are now set to vote on the whole tobacco taxation package on November 9.

What happened

A compromise text circulated by the Irish presidency on October 26, and seen by Agence Europe, revises the minimum excise duty the EU would require on nicotine pouches (and other "novel" tobacco-free nicotine products). The new staged minimums are:

  • 2028–2029: 10% of retail price, or €30 per kilogram, whichever calculation a country's tax structure uses.
  • 2030–2031: 25% of retail price, or €40 per kilogram.
  • From 2032: 50% of retail price, or €50 per kilogram.

That €50/kg top rate is down from the €80/kg previously on the table, and far below the European Commission's original July 2025 proposal of €143/kg. The 50%-of-retail-price alternative calculation is unchanged throughout.

Following an October 28 meeting of EU ambassadors, Ireland's presidency decided the text was ready for ministers. According to Bloomberg Tax, which reviewed a readout of that meeting, the presidency's position is that "the compromise text proposed is balanced and provides the basis for agreement." The EU Council has now formally put the tobacco taxation package — covering cigarettes, e-liquids, heated tobacco and nicotine pouches — on the agenda for the Economic and Financial Affairs Council (ECOFIN) meeting in Brussels on November 9, seeking a "general approach," according to the Council's own published meeting agenda.

Why it matters

EU tax directives need unanimous approval from all 27 member states, and Sweden has been the lone holdout since this proposal first started moving. Sweden currently taxes tobacco-free nicotine pouches far below what Brussels wants: even the newly discounted €50/kg rate would still be well above what Sweden charges domestically today.

Sweden's objection isn't really about the exact euro figure — it's about principle. Stockholm argues that smoke-free nicotine products shouldn't be taxed like combustible tobacco, since they carry a different risk profile. Public-health advocates on the other side argue that cheap, widely available flavored nicotine products risk pulling in younger users, and want taxation to reflect that.

There's a complication specific to this round: Sweden has been run by a caretaker government since its September election, and coalition talks are still unresolved. According to Agence Europe, Sweden told the October 28 ambassadors' meeting that without a sitting government, it can't offer any position beyond what it already said back in June — opposition to the prior compromise. A caretaker administration with no fresh negotiating mandate is not in a strong position to say yes to a new number, however much lower it is.

What's next

Ministers meet in Brussels on November 9 to try to reach a "general approach" — political agreement among the member states — on the directive. Even if that happens, a general approach isn't final law: the package would still need to go through the EU's full legislative process and be transposed into national law in each country before any new nicotine pouch tax actually takes effect, with the earliest tier not kicking in until 2028 under the current draft.

If Sweden holds its veto on November 9, as its own caretaker position suggests it might, the file carries over past Ireland's presidency, which ends in December. Lithuania takes over the Council presidency in January 2027, meaning this fight could run into a fourth EU presidency since the Commission first proposed it.
