What the claim says
The authorized claim is exact, and Swedish Match (owned by Philip Morris International) can only use it verbatim on the 20 covered products: "Using ZYN instead of cigarettes puts you at a lower risk of mouth cancer, heart disease, lung cancer, stroke, emphysema, and chronic bronchitis."
Note what it does not say: it is a comparison to cigarettes, not a statement that ZYN is safe or risk-free. FDA's own language makes clear there is no safe tobacco or nicotine product, and the healthiest option is to quit entirely.
Which products are covered
The orders apply to specific products, not the whole category. The 20 variants are 10 flavors, each in 3 mg and 6 mg:
- Cool Mint, Peppermint, Spearmint, Wintergreen, Menthol
- Citrus, Coffee, Cinnamon, Smooth, Chill
The same products had already been authorized for sale through the regular PMTA process on January 16, 2025, when ZYN became the first nicotine pouch authorized by FDA. The MRTP orders are a second, separate layer: permission to market with a risk-comparison claim.
What the order demands in return
The authorization is not a free pass. It carries conditions:
- Swedish Match must run postmarket surveillance and studies, including assessments of how consumers actually use the products and whether they understand the risk information.
- The orders expire in five years, and renewal requires a new review.
- FDA can modify or withdraw the orders if continued marketing no longer benefits public health — including if use by people who would not otherwise use nicotine increases.
Why it matters
This is a regulatory precedent, not just a ZYN marketing win. Modified risk orders have previously gone to snus products and heated tobacco — this is the first for pouches, the fastest-growing nicotine category in several markets. For manufacturers, it shows FDA will accept comparative risk evidence for pouches when the science supports it. For regulators elsewhere — including European countries weighing pouch restrictions or bans — it is a reference point for a risk-based approach instead of prohibition.
The claim itself is also a real competitive weapon in the U.S. market: it's the kind of statement no unauthorized competitor can legally make.
