Netherlands Wants EU to Freeze All New Nicotine Products

The Netherlands is calling on the European Union to freeze the approval of all new nicotine products while it prepares sweeping domestic restrictions that will limit tobacco sales to specialty shops starting in 2032.

The proposal would halt the introduction of new nicotine products across the EU, including nicotine pouches, while member states figure out how to regulate the category. It's unclear whether the freeze would apply to new brands, new flavors, or both—or whether it would block products already authorized in some markets from entering others.

What's Happening in the Netherlands

The Dutch government is moving forward with a plan to ban tobacco sales at supermarkets, gas stations, and most other retail outlets by 2032. Under the new rules, only specialty tobacco shops will be allowed to sell tobacco products.

The timeline gives retailers six years to prepare, but the proposal signals a much broader ambition: using national policy to push for EU-wide restrictions on nicotine product innovation.

It's not yet clear whether nicotine pouches—which are not classified as tobacco products under EU law—would fall under the 2032 retail ban in the Netherlands. The Dutch proposal to the EU suggests the government sees pouches as part of the same regulatory problem.

Why the EU Freeze Matters

If the EU adopted a market freeze, it would effectively lock the nicotine pouch category in place. No new brands could launch EU-wide. No new flavors could be introduced. Companies with products in the pipeline would be stuck.

The proposal comes as EU regulators are already debating how to handle nicotine pouches under the revised Tobacco Products Directive. Some member states want pouches regulated like tobacco. Others want them treated like consumer goods. A freeze would buy time for that debate—but it would also kill momentum for the category in Europe's largest markets.

The Netherlands has not specified how long the freeze would last or what conditions would need to be met to lift it.

What's Next

The Dutch proposal will be discussed at the EU level, but there's no timeline for a decision. Individual member states can already restrict nicotine pouch sales under national law, but an EU-wide freeze would require agreement from the European Commission and member states.

For now, the 2032 retail restriction remains a domestic Dutch policy. Whether it becomes a template for the EU depends on how seriously other member states take the freeze proposal.
