What the laws actually ban
All six states restrict the sale of flavored e-cigarettes and vaping products. The exact scope varies by state — some include menthol, some carve out tobacco flavor, some extend to all non-tobacco flavors.
None of the six laws define nicotine pouches as tobacco products subject to the flavor ban. Pouches are smokeless, non-combustible oral nicotine products; state vaping laws typically target "electronic nicotine delivery systems" or vapor products specifically.
Why this matters for pouch retailers
If you sell both vapes and pouches, the distinction is critical. A retailer in Massachusetts can still legally stock ZYN Citrus or VELO Wintergreen, but not a mango-flavored vape pod.
The regulatory gap exists because most state flavor bans were written 2019–2021, when pouches were a fraction of today's market. Legislators targeted youth vaping; pouches weren't yet on the radar.
What's next
California's law is the most recent addition to the list. As pouch sales grow, state lawmakers may revisit the category — but for now, the bans remain vape-specific.
Retailers in these six states should verify local ordinances, which can be stricter than state law. Some cities (San Francisco, Minneapolis) have enacted broader flavor bans that do include pouches.
