Spain Reportedly Backs Off Its 0.99mg Nicotine Cap — But Tobacco-Only Flavors Stay
Spain's health ministry reportedly raises its proposed nicotine pouch cap from 0.99mg to 4mg per pouch — a market-saving shift that still leaves extra-strong products out and tobacco-only flavors in place.
Spain's health ministry is reportedly working with a 4mg-per-pouch nicotine cap in the latest version of its tobacco decree — a sharp retreat from the 0.99mg ceiling in the earlier draft that would have effectively wiped most pouches off Spanish shelves.
The reported change comes from trade outlet Nicotine Insider, which says the ministry has raised the proposed nicotine limit to 4mg per pouch as it moves to finalize the sweeping reform of Royal Decree 579/2017. The same report says the draft keeps the flavor restriction intact: pouches would be limited to tobacco flavors only, with no mint, fruit or other aromas.
Why the shift matters
A 0.99mg cap was never really a limit — it was a ban by another name. Most pouches sold in Spain range from roughly 3mg to 15mg per pouch, so the original ceiling would have removed nearly the entire market. At 4mg, standard-strength products survive, but premium and extra-strong segments (typically 8mg and up) still don't make the cut.
The stakes are not small. Spain's pouch market sold an estimated 5 million cans in 2025 and was projected to grow around 60% to 8 million cans in 2026, according to industry estimates cited by Tobacco Reporter — one of the fastest-growing pouch markets in Southern Europe.
Two other elements of the draft cut the other way. The flavor restriction to tobacco-only aromas would push out the products driving that growth. And the decree is still part of a broader package that brings pouches under tobacco-style regulation for the first time in Spain — licensing, labeling, health warnings and a 10-month transition for manufacturers, with retailers given 12 months to clear existing stock.
Not final yet
The decree has not been adopted. The text Spain notified to the European Commission under TRIS (notification 2025/0044/ES) still reflects the earlier framing, and the health ministry's own public-consultation notice describes the 0.99mg maximum. The reported move to 4mg suggests the ministry has responded to pushback during consultation and the EU notification process, but nothing is law until the Royal Decree publishes in Spain's Official State Gazette — and reportedly nothing is locked until then either.
The shift has since been picked up by TobaccoIntelligence (Sep 17), which reports the updated draft decree quadruples the proposed cap to 4mg per pouch while keeping the non-tobacco flavour ban intact — and notes the move may shape upcoming EU-wide rules. There's a telling detail in the EU paper trail: in Spain's official response through the Commission's TRIS process, the government itself discussed 4mg as a regulatory alternative, noting it aligns with higher-dose nicotine replacement products authorised in Spain and with the limit Latvia adopted for pouches. Spain defended 0.99mg at the time — the new draft suggests that position didn't survive review at the Council of State, where the revised text is reportedly now sitting. For consumers in Spain, the practical takeaway: pouches remain legal and on sale today, and even the toughest draft on the table leaves a legal, tobacco-flavored, standard-strength market in place — a very different outcome from the near-total ban the original cap implied.
