The daily pulse of the nicotine pouch market

The UK just set an age limit on nicotine pouches for the first time — it starts on 29 October

From 29 October 2026 it becomes a criminal offence to sell nicotine pouches to under-18s in the UK — with bans on free samples and promo discounts arriving the same day.

From 29 October 2026, selling a nicotine pouch to anyone under 18 becomes a criminal offence in the United Kingdom. It is the first time nicotine pouches have carried a legal age of sale there — until now, the tobacco-free pouches sat outside the rules that covered vapes and cigarettes.

The change comes from the Tobacco and Vapes Act 2026, which received Royal Assent on 29 April 2026. Government guidance published by the Department of Health and Social Care confirms pouches are squarely in scope: the "nicotine products" definition explicitly names nicotine pouches, nicotine strips and nicotine pearls — and covers synthetic nicotine too.

What changes on 29 October

  • Age of sale 18+: an offence for retailers, including online retailers, to sell any vaping or nicotine product to under-18s — in England, Wales, Scotland and Northern Ireland. Customers can be asked for ID.
  • Proxy purchasing ban: adults can no longer buy pouches on behalf of someone under 18.
  • Free distribution ban: no free samples, giveaway products or promotional coupons where the purpose or effect is to promote the product — in store, online, or via third parties.
  • Substantial discount ban: selling pouches or coupons at a substantial discount to promote them becomes an offence.
  • Penalties: a £200 fixed penalty notice in England, Wales and Scotland (subject to Assembly approval, £250 in Northern Ireland), rising to fines of up to £2,500 on summary conviction in England, Wales and Scotland — up to £5,000 in Northern Ireland. Repeat offenders face restricted premises or restricted sales orders: up to 12 months in England and Wales, up to two years in Scotland, and between 28 days and three years in Northern Ireland.

The Local Government Association, which represents the trading standards teams who will enforce this, warned in September that shops were "still selling them without asking for identification" and urged retailers not to leave it until Christmas week.

Why it matters for pouch users and buyers

For consumers, the practical effect is simple: expect to be asked for ID when buying pouches in the UK, in person or online, from 29 October. Under-18s lose legal access they technically had before, and adults buying for teenagers now commit an offence themselves.

For the industry, the free-giveaway and discount bans are the sharper edge. UK pouch brands and retailers have leaned on sampling and promotions to convert smokers; from 29 October, that playbook becomes a criminal matter rather than a marketing choice. The LGA also points retailers to the bigger shift landing on 1 January 2027, when tobacco sales to anyone born on or after 1 January 2009 become illegal — the generational ban the Act is really built around.

Not covered yet, and worth watching: the government has said regulations setting out the age-verification steps that give retailers a legal defence will be "debated in Parliament in due course" — so the exact compliance mechanics may still shift. Vending machine restrictions also come in the same day.
