The Tobacco and Vapes Act 2026
The Tobacco and Vapes Act 2026 received Royal Assent on 29 April 2026 (c. 18). It's the key piece of legislation affecting the sale of vaping and nicotine products in the UK, including nicotine pouches.
The Act brings nicotine pouches under explicit regulation for the first time — covering age of sale, advertising, free distribution, and promotional pricing. The Department of Health and Social Care published detailed guidance on 11 August 2026.
What changes on 29 October 2026
Age restriction: It will be an offence to sell any nicotine product — including pouches, strips, and pearls — to anyone under 18. Retailers must verify age before sale. Synthetic nicotine is explicitly covered.
Proxy purchasing: It will be an offence for an adult to buy nicotine pouches on behalf of someone under 18.
Free sample ban: It will be an offence to give away a nicotine product for free where the purpose or effect is to promote the product. This ends the free-sample and festival-giveaway marketing model for pouch brands.
Promotional discount ban: It will be an offence to sell nicotine products at a substantial discount, or to offer coupons at a substantial discount, where the purpose or effect is promotion.
Penalties
- Fixed penalty notice: £200 in England, Wales, and Scotland; £250 in Northern Ireland
- Summary conviction fine: up to £2,500 in England, Wales, and Scotland; up to £5,000 in Northern Ireland
- Restricted sale/premises orders: retailers who commit 3 offences within 2 years can be banned from selling nicotine products for up to 12 months (up to 2 years in Scotland)

Historically, nicotine pouches in the UK were regulated mainly under general product-safety rules rather than tobacco law. The 2026 Act changes that, aligning nicotine pouches with a clearer regulatory framework that treats them as nicotine delivery products — not supplements or wellness items.
